To Kill in Ihraam (Ahadith 1575 - 1578)


Bismillah.
Volume 3, Book 29, Number 52:
Narrated 'Abdullah bin 'Umar (radiallaahu `anhu):
Allah's Apostle (sallallaahu `alayhi wasallam) said, "It is not sinful of a Muhrim to kill five kinds of animals."

Volume 3, Book 29, Number 53:
One of the wives of the Prophet narrated:
The Prophet (sallallaahu `alayhi wasallam) said, "A Muhrim can kill (five kinds of animals.)"

Volume 3, Book 29, Number 54:
Narrated Hafsa (radiallaahu `anhaa):
Allah's Apostle (sallallaahu `alayhi wasallam) said, "It is not sinful (of a Muhrim) to kill five kinds of animals, namely: the crow, the kite, the mouse, the scorpion and the rabid dog."

Volume 3, Book 29, Number 55:
Narrated Aisha (radiallaahu `anhaa):
Allah's Apostle (sallallaahu `alayhi wasallam) said, "Five kinds of animals are harmful and could be killed in the Haram (Sanctuary). These are: the crow, the kite, the scorpion, the mouse and the rabid dog."
Al-Qaasim ibn Muhammad said: I heard ‘Aa’ishah, the wife of the Prophet (peace and blessings of Allaah be upon him), say: I heard the Messenger of Allaah (peace and blessings of Allaah be upon him) say:
“There are four things which are faasiq (corrupt) and may be killed at all times, whether one is in a state of ihraam [for Hajj and ‘Umrah] or not: kites, crows, mice/rats and mad dogs.”
Narrated by Muslim, 1198.
Ibn ‘Abbaas said: a mouse (or rat) came and started dragging the wick (of the lamp). It threw it in front of the Messenger of Allaah (peace and blessings of Allaah be upon him), onto the mat on which he was sitting, and it burnt a hole the size of a dirham. He said, “When you go to sleep, extinguish your lamps, for the Shaytaan will tell creatures like this to do something like this so that you will be burned.” Narrated by Abu Dawood, 5427.
The mice or rats that may live in people’s houses are among the harmful creatures or vermin (fuwaysiqah) which the Prophet (peace and blessings of Allaah be upon him) commanded us to kill in all situations, whether we are in ihraam or not. The root of the word fuwaysiqah (fasaqa) means to deviate from the right way and to do harm; hence a sinner is described as “faasiq”, and these animals are called fawaasiq, as a metaphor for their evil nature; or it was said that it is because it is not haraam to kill them, whether one is in ihraam or not, for they have no sanctity or protection in any circumstances.

Tahneek & Branding (Hadith No. 1278)

Volume 2, Book 24, Number 577:
Narrated Anas (radiallaahu `anhu):
Some people from 'Uraina tribe came to Medina and its climate did not suit them, so Allah's Apostle (sallallaahu `alayhi wasallam) allowed them to go to the herd of camels (given as Zakat) and they drank their milk and urine (as medicine) but they killed the shepherd and drove away all the camels. So Allah's Apostle (sallallaahu `alayhi wasallam) sent (men) in their pursuit to catch them, and they were brought, and he had their hands and feet cut, and their eyes were branded with heated pieces of iron and they were left in the Harra (a stony place at Medina) biting the stones.

Today's Hadith:

Volume 2, Book 24, Number 578:
Narrated Anas bin Malik (radiallaahu `anhu):
took 'Abdullah bin Abu Talha (radiallaahu `anhu) to Allah's Apostle (sallallaahu `alayhi wasallam) to perform Tahnik for him. (Tahnik was a custom among the Muslims that whenever a child was born they used to take it to the Prophet (sallallaahu `alayhi wasallam) who would chew a piece of date and put a part of its juice in the child's mouth). I saw the Prophet (sallallaahu `alayhi wasallam) and he had an instrument for branding in his hands and was branding the camels of Zakat.
Branding of animals is allowed, but branding on the face is not. Prophet (sallallaahu `alayhi wasallam) forbade this act and cursed its doer.
About Tahneek: It is Sunnah (recommended) to do tahneek for the child when he is born: 
It was narrated that Anas ibn Maalik (may Allaah be pleased with him) said: The son of Abu Talhah was sick. Abu Talhah went out and the child died, and when Abu Talhah returned he said, “What happened to my son?” Umm Sulaym (his wife) said, ‘He is quieter than he was.” Then she brought him his dinner and he ate, then he had marital relations with her, and when he finished she said, “They buried the child.” The following morning, Abu Talhah went to the Messenger of Allaah (peace and blessings of Allaah be upon him) and told him what had happened. He said, “Did you have marital relations last night?” He said, “Yes.” He said, “O Allaah, bless them.” She later gave birth to a boy. Abu Talhah said to me, “Keep him until I bring him to the Prophet (peace and blessings of Allaah be upon him).” He brought him to the Prophet (peace and blessings of Allaah be upon him) and I sent some dates with him. The Prophet (peace and blessings of Allaah be upon him) took him and said, “Is there anything with him?” They said, “Yes, some dates.” The Prophet (peace and blessings of Allaah be upon him) took some and chewed it, then he took some from his mouth and put it in the child’s mouth (tahneek), and named him ‘Abd-Allaah. 
Narrated by al-Bukhaari, 5153; Muslim, 2144 
Al-Nawawi said: 
The scholars are agreed that it is mustahabb (preferred)to do tahneek with dates for the child when he is born; if that is not possible then to use some similar kind of sweet. The dates should be chewed until they become soft enough to be swallowed, then the child’s mouth should be opened and a little of the dates put in his mouth.

No Zakah on Horses (Ahadith 1201 - 1202)


Bismillah.
Volume 2, Book 24, Number 542:
Narrated Abu Huraira (radiallaahu `anhu):
Allah's Apostle (sallallaahu `alayhi wasallam) said, "There is no Zakat either on a horse or a slave belonging to a Muslim".
Volume 2, Book 24, Number 543:
Narrated Abu Huraira (radiallaahu `anhu):
The Prophet (sallallaahu `alayhi wasallamsaid,"There is no Zakat either on a slave or on a horse belonging to a Muslim".
The animals on which zakaah is due are the an’aam animals, which are: 
  • Camels
  • Cattle, including buffalo
  • Sheep, which includes goats 
This applies if their number reaches the nisaab and they are put out to pasture, i.e. they graze and feed from plants on the land, and their owner does not purchase feed for them.
Other kinds of animals are not subject to zakaah unless they are for dealing and trading, in which case zakaah must be paid as for trade goods, such as a person who deals in ostriches, ducks, chickens, horses and so on. 
If they are an’aam animals that are given feed, but their owner trades in them, then he should pay zakaah as for trade goods, so he should work out their value when one year has passed and pay one-quarter of one-tenth of their value as zakaah. 
It says in al-Mawsoo’ah al-Fiqhiyyah (23/250):
The fuqaha’ are unanimously agreed that camels, cattle and sheep are the kinds of animals on which zakaah must be paid, and they quoted many ahaadeeth as evidence for that. There is a difference of opinion with regard to horses. As for mules, donkeys and other kinds of animals, no zakaah is due on them unless they are for trade. End quote.
