Bad Animal (Hadith No. 1580)


Bismillah.
Volume 3, Book 29, Number 57:
Narrated 'Aisha (radiallaahu `anhaa), the wife of the Prophet (sallallaahu `alayhi wasallam):
Allah's Apostle (sallallaahu `alayhi wasallam) called the salamander a bad animal, but I did not hear him ordering it to be killed."
Wikipedia says Salamanders are typically characterized by a superficially lizard-like appearance, with slender bodies, short noses, and long tails.

Why are Salamanders bad?

In al-Saheehayn and elsewhere it is narrated via Sa’eed ibn al-Musayyib that Um Shareek told him that the Prophet (peace and blessings of Allaah be upon him) told her to kill salamanders. According to the report narrated by al-Bukhaari, he said: “It (the salamander) used to blow on Ibraaheem, peace be upon him.
In Saheeh Muslim it is narrated via ‘Abd al-Razzaaq, Mu’ammar told us from al-Zuhri from ‘Aamir ibn Sa’d from his father that the Prophet (peace and blessings of Allaah be upon him) enjoined the killing of salamanders and called them mischief doers.

To Kill or not to Kill?

Killing salamanders is prescribed because there is a great deal of evidence to that effect.
Killing salamanders with one blow brings more reward than killing them with two blows. This was narrated in Saheeh Muslim via Khaalid ibn ‘Abd-Allaah from Suhayl ibn Abi Saalih from his father from Abu Hurayrah, that the Prophet (peace and blessings of Allaah be upon him) said:
Whoever kills a salamander with one blow will have such and such hasanah (good deeds); whoever kills it with the second blow will have such and such hasanah, less than the first; and whoever kills it with three blows will have such and such hasanah – less that the second.
Ibn Maajah (may Allaah have mercy on him) narrated in his Sunan from Saa’ibah the slave woman of al-Faakih ibn al-Mugheerah that she entered upon ‘Aa’ishah and saw a spear sitting there in her house. She said, “O Mother of the Believers, what do you do with this?” She said, “We kill these salamanders with it, because the Prophet of Allaah (peace and blessings of Allaah be upon him) told us that when Ibraaheem was thrown into the fire, there was no animal on earth but it tried to extinguish the fire, except for the salamander, which was blowing on the fire (to keep it burning). So the Messenger of Allaah (peace and blessings of Allaah be upon him) commanded that they should be killed.”

Eating from the Slaughtered Animal's Meat (Ahadith 1477 - 1478)

Volume 2, Book 26, Number 777:
Narrated Ibn Juraij:
'Ata' said, "I heard Jabir bin 'Abdullah (radiallaahu `anhu) saying, 'We never ate the meat of the Budn for more than three days of Mina. Later, the Prophet (sallallaahu `alayhi wasallam) gave us permission by saying: 'Eat and take (meat) with you. So we ate (some) and took (some) with us.' " I asked 'Ata', "Did Jabir (radiallaahu `anhu) say (that they went on eating the meat) till they reached Medina?" 'Ata' replied, "No."

Volume 2, Book 26, Number 778:
Narrated 'Amra:
I heard 'Aisha (radiallaahu `anhaa) saying, "We set out (from Medina) along with Allah's Apostle (sallallaahu `alayhi wasallam) five days before the end of Dhul-Qa'da with the intention of performing Hajj only. When we approached Mecca, Allah's Apostle (sallallaahu `alayhi wasallam) ordered those who had no Hadi along with them to finish the lhram after performing Tawaf of the Ka'ba, (Safa and Marwa). 'Aisha (radiallaahu `anhaa) added, "Beef was brought to us on the Day of Nahr and I said, 'What is this?' Somebody said, 'The Prophet (sallallaahu `alayhi wasallam) has slaughtered (cows) on behalf of his wives.' "

Both these Ahadith give evidence that it's okay to eat from the animal you sacrifice. Rather, it's Sunnah. Prophet (sallallaahu `alayhi wasallam) encouraged companions to do so (as in the first Hadith), and sent some for his wives (as in the second Hadith). So eat from the meat whenever an animal is sacrificed (Eid/aqeeqah/Hajj etc.).

So Much Charity (Hadith No. 1476)


Bismillah.
Volume 2, Book 26, Number 776:
Narrated 'Ali (radiallaahu `anhu):
The Prophet (sallallaahu `alayhi wasallam) offered one hundred Budn as Hadi and ordered me to distribute their meat (in charity) and I did so. Then he ordered me to distribute their covering sheets in charity and I did so. Then he ordered me to distribute their skins in charity and I did so.
100 camels. Their meat, skins, everything was given in charity. Unbelievable! Who would do that?!
If you think about it, one camel can suffice seven families. So he gave in charity what would've been enough for 700 families (they would divide it further for use at home and giving in charity). He gave it all away. SubhanAllah, what a wise man! He always preferred the `aysh (life) of the Aakhirah over this life. And what is charity but a ticket to Jannah?
You possess only what will not be lost in a shipwreck.
As for the fiqh of it, we've already discussed in one of the previous posts that portions for charity/family etc. are not fixed for sacrificial animals. Ratio can be varied according to need.

Butcher's Wage (Ahadith 1474 - 1475)

Volume 2, Book 26, Number 773:
Narrated Anas bin Malik (radiallaahu `anhu):
The Prophet (sallallaahu `alayhi wasallam) offered four Rakat of Zuhr prayer at Medina and two Rakat of 'Asr prayer at Dhul-Hulaifa. Narrated Aiyub: "A man said: Anas (radiallaahu `anhu) said, "Then he (the Prophet (sallallaahu `alayhi wasallam) passed the night there till dawn and then he offered the morning (Fajr) prayer, and mounted his Mount and when it arrived at Al-Baida' he assumed Ihram for both 'Umra and Hajj."

Today's Ahadith:

Volume 2, Book 26, Number 774:
Narrated 'Ali (radiallaahu `anhu):
The Prophet (sallallaahu `alayhi wasallam) sent me to supervise the (slaughtering of) Budn (Hadi camels) and ordered me to distribute their meat, and then he ordered me to distribute their covering sheets and skins. 'All added, "The Prophet (sallallaahu `alayhi wasallam) ordered me to supervise the slaughtering (of the Budn) and not to give anything (of their bodies) to the butcher as wages for slaughtering."

Volume 2, Book 26, Number 775:
Narrated 'Ali (radiallaahu `anhu):
The Prophet (sallallaahu `alayhi wasallam) ordered me to supervise the (slaughtering) of Budn (Hadi camel) and to distribute their meat, skins and covering sheets in charity and not to give anything (of their bodies) to the butcher as wages for slaughtering.
It is not permissible to sell part of the sacrificial animal or udhiyah (sacrifice on Eid), or to sell all of it, except in cases where it is done in accordance with the purpose of the sacrifice, because what a person has given to Allaah cannot be sold at all. 
It says in al-Mughni: It is not permissible to sell any part of it – i.e., the sacrificial animal – but if the butcher is poor and he gives him something because he is poor, in addition to the wages that he gives him, that is permissible, because he is entitled to take some of it because of being poor, not as payment for his work. End quote (3/222)
Shaykh Ibn ‘Uthaymeen said: It is haraam to sell any part of the udhiyah, whether the meat or anything else, even the skin. The butcher should not be given anything from it in partial payment for his work, because that is like selling. (Risaalah Ahkaam al-Hadiy wa’l-Udhiyah) 

Etiquette of Slaughtering Animals (Ahadith 1471 - 1472)

Volume 2, Book 26, Number 771:
Narrated Zaid bin Jubair:
I saw Ibn 'Umar (radiallaahu `anhu) passing by a man who had made his Badana sit to slaughter it. Ibn 'Umar (radiallaahu `anhu) said, "Slaughter it while it is standing with one leg tied up as is the tradition of Muhammad (sallallaahu `alayhi wasallam)."

Volume 2, Book 26, Number 772:
Narrated Anas (radiallaahu `anhu):
The Prophet (sallallaahu `alayhi wasallam) offered four Rakat of Zuhr prayer at Medina; and two Rakat of 'Asr prayer at Dhul-hulaifa and spent the night there and when (the day) dawned, he mounted his Mount and started saying, "None has the right to be worshipped but Allah, and Glorified be Allah." The Prophet (sallallaahu `alayhi wasallam) slaughtered seven Budn (camel) with his own hands while the camels were standing He also sacrificed two horned rams (black and white in color) at Medina.
There are certain etiquettes one must abide by when slaughtering an animal for a sacrificial offering. However, these etiquettes are not conditional for the validity of a sacrifice. So the sacrifice is still valid even in their absence. Among these etiquettes are:
1. He should face the Qiblah with the animal at the time of slaughtering.
2. He must slaughter the animal in a good manner, which is by quickly and firmly passing a sharpened blade over the neck area.
Some scholars hold the view that this etiquette is obligatory based on the implication found in the Prophet’s saying: "Verily Allaah has prescribed proficiency in everything. So when you kill, kill proficiently. And when you sacrifice, sacrifice proficiently. Each of you should sharpen his blade and lessen the pain inflicted on his sacrificial offering." [Reported by Muslim]
This opinion is the correct view.
3. The slaughter of a camel must be done by cutting the area just below the neck and above the chest. This is known as nahr. As for all other types of animals, their necks should be sliced.
A camel should be slaughtered while standing and with its (front) left leg tied. If it is difficult to do it this way, the camel can be slaughtered while kneeling.
As for all of the other animals, they are to be slaughtered while lying flat on their left side. However, if the one slaughtering is a lefty, he may use his left hand and lay the animal down on its right side. This is so long as doing it this way is easier upon the animal and more convenient for the one slaughtering.
It is also prescribed for him to place his foot on the collar of the animal to give him better control. As for making the animal kneel and tying its legs together, there is no basis for this in the Sunnah. Some scholars mentioned that one of the reasons why the legs should not be tied is so that the outflow of blood can increase as a result of the animal’s constant motion and instability.
4. The throat and esophagus of the animal should be cut in addition to its jugular veins. For more on this, refer to the discussion on this under the eighth condition of slaughtering.
5. The blade should be concealed from the view of the animal when sharpening it. This means that the animal should not see the blade until the time of the actual slaughter.
6. One should glorify Allaah (by saying Allaahu Akbar) after mentioning His Name (by saying Bismillaah) when slaughtering.
7. One should name the person whom the sacrificial offering (udhiyah) or ‘aqeeqah is being performed for after mentioning Allaah’s Name and glorifying Him. He should also ask Allaah to accept it from him.
So for example, he should say: "In the Name of Allaah, Allaah is the Greatest. O Allaah, this is from You and for You on behalf of me" if he is performing the slaughter for himself or "…on behalf of so and so" if the slaughter is being done on behalf of someone else. And he should say: "O Allaah, accept this from me" if he is performing the slaughter for himself or "…accept this from so and so" if the slaughter is being done on behalf of someone else.

Slaughter the Animals for Sacrifice Yourself (Hadith No. 1470)

Volume 2, Book 26, Number 770:
Narrated Sahl bin Bakkar:
The narration of Anas (radiallaahu `anhu) abridged, saying, "The Prophet (sallallaahu `alayhi wasallam) slaughtered seven Budn (camels) while standing, with his own hands. On the day of 'Id-ul-Adha he slaughtered (sacrificed) two horned rams, black and white in color.
  1. It's Sunnah to slaughter your animal of sacrifice yourself. If you don't want to do the whole thing, at least slit the throat (for goat/sheep/cow etc.).
  2. Although one sheep (or 1/7th of a cow or camel) is enough for one man and his family, there's no limit to the maximum amount of animals you may slaughter. The more, the better. Keep some for yourself and your family, and give the rest as sadaqah. More on it here.
  3. Prophet (sallallaahu `alayhi wasallam) was so strong mashaAllah! Imagine slaughtering seven camels in one go. :O
    It takes a lot of strength! You'd know if you've seen a camel being slaughtered. If not, YouTube/Google it.

Slaughtering Place (Manhar) of the Prophet [sallallaahu `alayhi wasallam] (Ahadith 1468 - 1469)

Volume 2, Book 26, Number 768:
Narrated Nafi':
'Abdullah (bin 'Umar) (radiallaahu `anhu), used to slaughter (his sacrifice) at the Manhar. ('Ubaidullah, a sub-narrator said, "The Manhar of Allah's Apostle (sallallaahu `alayhi wasallam).")

Volume 2, Book 26, Number 769:
Narrated Nafi':
Ibn 'Umar (radiallaahu `anhu) used to send his Hadi from Jam' (to Mina) in the last third of the night with the pilgrims amongst whom there were free men and slaves, till it was taken into the Manhar (slaughtering place) of the Prophet (sallallaahu `alayhi wasallam).
Prophet (sallallaahu `alayhi wasallam) slaughtered his sacrificial animals in Mina. That's where his 'manhar' was.

Hajj - Slaughtering on Behalf of Others (Hadith No. 1467)

Volume 2, Book 26, Number 766:
Narrated Nafi':
Ibn 'Umar (radiallaahu `anhu) intended to perform Hajj in the year of the Hajj of Al-Harawriya during the rule of Ibn Az-Zubair. Some people said to him, "It is very likely that there will be a fight among the people, and we are afraid that they might prevent you (from performing Hajj)." He replied, "Verily, in Allah's Apostle (sallallaahu `alayhi wasallam) there is a good example for you (to follow). In this case I would do the same as he had done. I make you witness that I have intended to perform 'Umra." When he reached Al-Baida', he said, "The conditions for both Hajj and 'Umra are the same. I make you witness that I have intended to perform Hajj along with 'Umra." After that he took a garlanded Hadi (to Mecca) which he bought (on the way). When he reached (Mecca), he performed Tawaf of the Ka'ba and of Safa (and Marwa) and did not do more than that. He did not make legal for himself the things which were illegal for a Muhrim till it was the Day of Nahr (sacrifice), when he had his head shaved and slaughtered (the sacrifice) and considered sufficient his first Tawaf (between Safa and Marwa), as a (Sa'i) for his Hajj and 'Umra both. He then said, "The Prophet (sallallaahu `alayhi wasallam) used to do like that."

Today's Hadith:

Volume 2, Book 26, Number 767:
Narrated 'Amra bint 'AbdurRahman:
I heard 'Aisha (radiallaahu `anhaa) saying, "Five days before the end of Dhul-Qa'ada we set out from Medina in the company of Allah's Apostle (sallallaahu `alayhi wasallam) with the intention of performing Hajj only. When we approached Mecca, Allah's Apostle (sallallaahu `alayhi wasallam) ordered those who had no Hadi with them to finish their lhram after performing Tawaf of the Ka'ba and (Sa'i) and between Safa and Marwa." 'Aisha (radiallaahu `anhaa) added, "On the day of Nahr (slaughtering of sacrifice) beef was brought to us. I asked, 'What is this?' The reply was, 'Allah's Apostle (sallallaahu `alayhi wasallam) has slaughtered (sacrifices) on behalf of his wives.' "
Prophet (sallallaahu `alayhi wasallam) slaughtered the animals (hadiy) on behalf of his wives. Does it apply on wives only or can one slaughter the hadiy on behalf of anyone? I'll update this post once I have the answer inshaAllah.

Hajj - Giving Slaughtered Animal in Charity (Hadith No. 1465)

Volume 2, Book 26, Number 765:
Narrated 'Ali (radiallaahu `anhu):
Allah's Apostle (sallallaahu `alayhi wasallam) ordered me to give in charity the skin and the coverings of the Budn which I had slaughtered.
Shaykh al-Islam Ibn Taymiyah (may Allah have mercy on him) said: 
If we say concerning the hadiy and udhiyah that it is mustahabb to eat one third and give one third in charity, that only applies if there is no reason to increase the portion of one of the categories of recipients. But if it so happens that there are a lot of poor people, then we regard it as preferable to give more than one third in charity; the same applies if the poor have received meat in abundance (in this case, their share may be reduced); and the same applies to what one may keep. Wherever the need is greatest, that may change the ratios given to the three categories of recipients.

Hajj - Animal of Sacrifice to be Brought from Outside Haram (Hadith No. 1451)

Volume 2, Book 26, Number 751:
Narrated Nafi':
'Abdullah (bin 'Abdullah) bin 'Umar said to his father, "Stay here, for I am afraid that it (affliction between Ibn Zubair and Al-Hajjaj) might prevent you from reaching the Ka'ba." Ibn 'Umar (radiallaahu `anhu) said, "(In this case) I would do the same as Allah's Apostle (sallallaahu `alayhi wasallam) did, and Allah has said, 'Verily, in Allah's Apostle (sallallaahu `alayhi wasallam), you have a good example (to follow).' So, I make you, people, witness that I have made 'Umra compulsory for me." So he assumed lhram for 'Umra. Then he went out and when he reached Al-Baida', he assumed Ihram for Hajj and 'Umra (together) and said, "The conditions (requisites) of Hajj and 'Umra are the same." He, then brought a Hadi from Qudaid. Then he arrived (at Mecca) and performed Tawaf (between Safa and Marwa) once for both Hajj and 'Umra and did not finish the lhram till he had finished both Hajj and 'Umra.

According to the commentator Ibn Battaal, Imaam Bukhari mentioned this Hadith here in order to show the opinion of Ibn `Umar (radiallaahu `anhu) concerning the hadi (animal of sacrifice). He used to say that the hadi has to be bought/brought from outside of the boundaries of haram. And in later posts, we'll see that it must be sacrificed inside haram.

It is not Sunnah if you have done ‘Umrah to buy a sheep and slaughter it; the Sunnah is to bring a sheep with you from your country or at least from the miqaat or the closest point outside the sanctuary, according to some scholars, and this is called driving the hadiy. But offering a sacrifice after ‘Umrah without having brought the animal with you is not part of the Sunnah. End quote.

Hajj - Ridin' the Animal of Sacrifice (Ahadith 1448 - 1449)

Volume 2, Book 26, Number 748:
Narrated Abu Huraira (radiallaahu `anhu):
Allah's Apostle (sallallaahu `alayhi wasallam) saw a man driving his Badana (sacrificial camel). He said, "Ride on it." The man said, "It is a Badana." The Prophet (sallallaahu `alayhi wasallam) said, "Ride on it." He (the man) said, "It is a Badana." The Prophet (sallallaahu `alayhi wasallam) said, "Ride on it." And on the second or the third time he (the Prophet (sallallaahu `alayhi wasallam)) added, "Woe to you."

Volume 2, Book 26, Number 749:
Narrated Anas (radiallaahu `anhu):
The Prophet (sallallaahu `alayhi wasallam) saw a man driving a Badana. He said, "Ride on it." The man replied, "It is a Badana." The Prophet (sallallaahu `alayhi wasallam) said (again), "Ride on it." He (the man) said, "It is a Badana." The Prophet (sallallaahu `alayhi wasallam) said thrice, "Ride on it."
What do you say to a person who doesn't listen to you even when you give him an instruction three times? Answer: woe to you! (It has various interesting translations in Urdu btw.) :P
Coming to the point, one may ride the animal he/she is going to use as hadi (sacrificial animal for Hajj). There are certain conditions as to the minimum age of the animal. In Fataawa al-Lajnah al-Daa’imah, it says:
The shar’i evidence indicates that what is acceptable in the case of sheep is that which has reached the age of six months; in the case of goats it is that which has reached the age of one year; in the case of cattle it is that which has reached the age of two years; and in the case of camels it is that which has reached the age of five years. Anything younger than that is not acceptable as a hadiy or udhiyah. This is what is meant by “a Hady such as you can afford,” because the texts from the Qur'aan and Sunnah explain one another.
And Allah is the source of strength; may Allah send blessings and peace upon our Prophet Muhammad and his family and Companions. End quote.

Compensation, Rikaaz and Khumus (Hadith No. 1275)

Volume 2, Book 24, Number 575:
Narrated Abu Huraira (radiallaahu `anhu):
Allah's Apostle (sallallaahu `alayhi wasallam) said, "There is no compensation for one killed or wounded by an animal or by falling in a well, or because of working in mines; but Khumus is compulsory on Rikaz."
As for the first part of the Hadith, scholars explain that if someone gets hurt (or their property gets damaged) because of another's animal or by falling in a well, or because of working in mines, there are two possible reasons:
  1. Either the owner of that animal/well/mine was responsible;
  2. Or he/she was not.
In case the owner was responsible (e.g. he was guiding the animal), he'll pay compensation for the loss from his own wealth. And if he was not responsible, no compensation is due on him. More on it here.
Rikaaz refers to what is buried in the earth of the wealth of the Jaahiliyyah. The people of the Jaahiliyyah are the ones who existed before the coming of the Prophet (peace and blessings of Allaah be upon him), no matter what religion they followed. Islam has enjoined that when it is extracted, the khums be paid on it, as zakaah according to some scholars and as fay’ according to others. The rest belongs to whoever extracted it, if it was extracted from land that he owns, or from ruins or common land such as the street and so on.
