Marriage Fiqh: A sister cannot be married against wife [as Mehar] (Shighar is not permitted)


In some tribal areas of Indo pak, Afghanistan and Arabia, some times a sister is married with brother of wife without paying mehar this is known as Nikah of Shighar.

This is a very bad tradition and it increases the chances of divorce and domestic voilence. Rasool salal laho aliehi waslam has banned it.

Now a man cannot marry her sister or daughter with his brother in law without mehar. He can however marry her with his brother in law without setting any link of this marriage with his own marriage.


Marriage Fiqh: Temporary marriage or Mutah is not allowed in Islam:


There is no concept of temporary marriage in Islam.It has been mentioned in many hadiths of Rasool salal laho aliehi wasalam.
Some of them are as follows:

"Rabi' b. Sabra reported that his father went on an expedition with Allah's Messenger (may peace be upon him) during the Victory of Mecca, and we stayed there for fifteen days (i. e. for thirteen full days and a day and a night), and Allah's Messenger (may peace be upon him) permitted us to contract temporary marriage with women. So I and another person of my tribe went out, and I was more handsome than he, whereas he was almost ugly. Each one of us had a cloaks, My cloak was worn out, whereas the cloak of my cousin was quite new. As we reached the lower or the upper side of Mecca, we came across a young woman like a young smart long-necked she-camel. We said: Is it possible that one of us may contract temporary marriage with you? She said: What will you give me as a dower? Each one of us spread his cloak. She began to cast a glance on both the persons. My companion also looked at her when she was casting a glance at her side and he said: This cloak of his is worn out, whereas my cloak is quite new. She, however, said twice or thrice: There is no harm in (accepting) this cloak (the old one). So I contracted temporary marriage with her, and I did not come out (of this) until Allah's Messenger (may peace be upon him) declared it forbidden. (Sahih Muslim, Book 8, Number 3253)
 
Narrated 'Ali: "I said to Ibn 'Abbas, 'During the battle of Khaibar the Prophet forbade (Nikah) Al-Mut'a [Temporary Marriage in English] and the eating of donkey's meat.' (Sahih Bukhari, Wedlock, Marriage (Nikaah), Volume 7, Book 62, Number 50)
 
Narrated Jabir bin 'Abdullah and Salama bin Al-Akwa': "While we were in an army, Allah's Apostle came to us and said, "You have been allowed to do the Mut'a (marriage), so do it." Salama bin Al-Akwa' said: Allah's Apostle's said, "If a man and a woman agree (to marry temporarily), their marriage should last for three nights, and if they like to continue, they can do so; and if they want to separate, they can do so." I do not know whether that was only for us or for all the people in general. Abu Abdullah (Al-Bukhari) said: 'Ali made it clear that the Prophet said, "The Mut'a marriage has been cancelled (made unlawful)." (Sahih Bukhari, Wedlock, Marriage (Nikaah), Volume 7, Book 62, Number 52)"
 
Narrated Saburah ibn Ma'bad al-Juhani: "The Apostle of Allah (peace_be_upon_him) prohibited temporary marriage with women. (Sunan Abu-Dawud, Marriage (Kitab Al-Nikah), Book 11, Number 2068)"

 
From all the above mentioned hadiths it is clear that temporary marriages were declared haram by Rasool salal laho aliehi wasalam.And although they were initially halal but this cannot be an evidence for their permission because when prophet salal laho aliehi wasalam had declared it haram and cancelled its previous permission how can it be legal now.?







Marriage Fiqh: There is no harm in Polygamy:


It is allowed for Muslim men that they can have more than 1 wives and they can marry upto four provided that they do justice with all of them.Allah swt says in Holy Quran:


Marry women of your choice, two or three, or four but if you fear that you shall not be able to deal justly (with them), then only one or (the captives and the slaves) that your right hands possess. That is nearer to prevent you from doing injustice. (An-Nisa 4:3)


Justice is an obligation on Muslim men and they will be accountable before Allah swt if they do injustice .But this has to be kept in mind that Quantitative justice is more important than qualitative justice which means a man must try to distribute his resources and time equally among his wives but if he has more love for one among them he will not be accountable for it.

Allah swt says in Holy Quran:

You will never be able to do perfect justice between wives even if it is your ardent desire, so do not incline too much to one of them (by giving her more of your time and provision) so as to leave the other hanging (i.e. neither divorced nor married). And if you do justice, and do all that is right and fear Allâh by keeping away from all that is wrong, then Allâh is Ever Oft¬Forgiving, Most Merciful. (An-Nisa 4:129)


Allah swt says in Holy Quran:


And if a woman fears cruelty or desertion on her husband's part, there is no sin on them both if they make terms of peace between themselves; and making peace is better. And human inner-selves are swayed by greed. But if you do good and keep away from evil, verily, Allâh is Ever Well¬Acquainted with what you do. (An-Nisa 4:128)

So the summary of above discussion is that a man can marry more than one woman provided that he does justice with all of them.And if he finds himself weak to do justice than he can look after only one to avoid wrath of Allah for doing injustice.

An important issue in this regard is that if one or more of the wives in polygamy surrender one or more of their rights with free will it is allowed for them.



Marriage Fiqh: Who Muslim can Marry and Who Muslim can not Marry


Muslim man can marry women form people of scriptures:
Muslim men are allowed to marry Christian and Jew women provided that they are modest.
Allah says in Holy Quran:

(Lawful to you in marriage) are chaste women from the believers and chaste women from those who were given the Scripture (Jews and Christians) before your time, when you have given their due Mahr (bridal money given by the husband to his wife at the time of marriage), desiring chastity (i.e. taking them in legal wedlock) not committing illegal sexual intercourse, nor taking them as girl-friends. (Al-Ma'idah 5:5)

So it is clear from above verse that any muslim man can marry any Christian or Jew lady provided that target is not adultery and time passing
Muslim women cannot marry Non Muslim men:
On the other hand Muslim women are not allowed to marry with Non Muslim men.
Allah swt says in Holy Quran:
They are not lawful (wives) for the disbelievers nor are the disbelievers lawful (husbands) for them. (Al-Ma'idah 5:5)

So it is clear from the above verse that the provision of marrying with people of scriptures is only for Muslim men not for Muslim women
Muslims cannot marry polytheists other than people of scriptures:
Muslim men are not allowed to marry polytheist women other than those belonging to people of scriptures. It is illegal for both Muslim men and women to marry people who are polytheists like Hindus,Buddhists,Sikhs,Qadiyanis,Bhais,Babis etc.
Allah swt says:

And do not marry Al-Mushrikât (idolatresses, etc.) till they believe (worship Allâh Alone). And indeed a slave woman who believes is better than a (free) Mushrikah (idolatress, etc.), even though she pleases you. And give not (your daughters) in marriage to Al-Mushrikûn till they believe (in Allâh Alone) and verily, a believing slave is better than a (free) Mushrik (idolater, etc.), even though he pleases you. Those (Al-Mushrikûn) invite you to the Fire, but Allâh invites (you) to Paradise and Forgiveness by His Leave, and makes His Ayât (proofs, evidences, verses, lessons, signs, revelations, etc.) clear to mankind that they may remember. (Al-Baqarah 2:221)

So a Muslim man should marry a Muslim woman and Muslim woman should marry a Muslim man .However it is allowed for Muslim man that they can marry woman from people of scriptures provided that she is modest.This is a permission from Allah swt but even for Muslim man a Muslim woman is far better than a Non Muslim woman.

A Sound character Muslim should not marry a loose character Person:


Allah swt has always demanded strong character from His worshippers.Allah swt says in Holy Quran:
And He loves those who purify themselves(Al-Baqarah 2:222)


On another instance Allah swt says:

And Allâh loves those who make themselves clean and pure (At-Tawbah 9:108)


These verse clearly indicate the importance of neatness and strong character that is why Allah swt has forbidden Muslims to marry loose character people.

Allah swt says:
The adulterer marries not but an adulteress or a Mushrikah and the adulteress none marries her except an adulterer or a Muskrik(An-Nur 24:3)


On another instance Allah swt says:

Bad women are for bad Men and bad men are for bad women and good women are for good men and good men for good women(An-Nur 24:26)

So it is very much clear from above verses that a Muslim men and women must choose a strong character person as their life partner.






Marriage Fiqh: Mehar is an obligation


For an Islamic marriage mehar is very important.Mehar is like gift of marriage from bride groom to bride.It can be a big amount or just a small gift of gold or silver ornament.
Allah swt has said in Holy Quran:

And give them their Mahr according to what is reasonable; (An-Nisa 4:25)

A bride groom cannot take back his mehar from her bride except in case of commit open illegal sexual intercourse.
It has been declared in Holy Quran:
O you who believe! You are forbidden to inherit women against their will, and you should not treat them with harshness, that you may take away part of the Mahr you have given them, unless they commit open illegal sexual intercourse. And live with them honourably. (An-Nisa 4:19)

Any one who tries to take back haq mehar from his wife after marriage is indeed a sinner.

Allah swt says

But if you intend to replace a wife by another and you have given one of them a Cantar (of gold i.e. a great amount) as Mahr, take not the least bit of it back; would you take it wrongfully without a right and (with) a manifest sin? (An-Nisa 4:20).



Marriage Fiqh: At least two witnesses are required for Marriage/Nikah


For an Islamic Nikah at least two witnesses are also required .Rasool salal laho aliehi wasalam said
“There is no Nikah without wali and two just witnesses”(Darqutnee)

The purpose of this condition is that married couple should not be accused of adultery and if some body accuses them the witnesses can make sure that it is wrong accusation.


Marriage Fiqh: No requirement of wali for revert migrant Muslim woman


It is an important point to be noted that if a revert Muslim woman leaves her family she does not need permission of her walis.She can come straight to any Muslim family for marriage
Allah swt has said in Holy Quran:

O you who believe! When believing women come to you as emigrants, examine them, Allâh knows best as to their Faith, then if you ascertain that they are true believers, send them not back to the disbelievers, they are not lawful (wives) for the disbelievers nor are the disbelievers lawful (husbands) for them. But give the disbelievers that (amount of money) which they have spent [as their Mahr] to them. And there will be no sin on you to marry them if you have paid their Mahr to them. (Al-Mumtahinah 60:10)
So any new Muslim woman can marry Muslim man if he pays her mehar

Marriage Fiqh: Women cannot be forced for Nikah:


Indeed consent of wali is very important for Nikah but on the other hand women cannot be forced for marriage.Whenever a woman is forced for Nikah that Nikah is invalid and a woman can break the ties of Nikah.
The evidence to support this fact is same hadith of sahih Muslim:

“Ibn Abbas (ra) reported Allah’s Messenger as saying: A previously married woman (thaib) has more right to her person than her guardian. And a virgin should also be consulted, and her silence implies her consent.”( Sahih Muslim, in Kitab an-Nikah)

This hadith clearly indicates that neither previously married woman nor virgin can be forced by their guardians for Nikah.Similarly when father of Hazrat Khansa binte Hazam radi Allaha anha married her without her will she came to prophet salal laho aliehi wasalam with complaint.Prophet salal laho aliehi wasalam cancelled her Nikah.
It means for an appropriate Nikah there should be consensus between wali and women



Marriage Fiqh: Consent of Wali or Guardian is very important


Islam disapproves all those marriages which are being done without consent of Wali.

Allah swt has said in Holy Quran:

Wed them with the permission of their own folk (guardians, Auliyâ' or masters) (An-Nisa 4:25)

On another instance Allah swt says while addressing walis of women:
Arrange the marriage of the spouseless among you – [Qur'an 24:32]

Similarly there are many hadiths which highlights importance of wali.Some of them are as follows:


“Abu Musa (ra) reported that Allah’s Messenger said, ‘Marriage is not performed if (consent of the) guardian is not there.” ( Al-Tirmidhi, 1101; Abu Dawood, 2085; Ibn Maajah, 1881. Classed as saheeh by Shaykh al-Albaani in Saheeh al-Tirmidhi, 1/318)”


“Ayesha (raa) reported that Allah’s Messenger said, ‘If any woman marries without the consent of her guardian then her marriage is void. Her marriage is void. Her marriage is void. If he cohabits with her then for her is the dower as the man enjoyed her. And if her awliya disputes with each other then the ruler is the wali of the one who has no wali ” (Al-Tirmidhi, 1102; Abu Dawood, 2083; Ibn Maajah, 1879. Classed as saheeh by al-Albaani in Irwa’ al-Ghaleel, 1840)”



Saeed ibne Musayyib narrated that ‘Umar ibn al-Khattab (ra) said, ‘the woman does not get married off unless with the permission of her wali or permission of someone responsible good judgment or the sultan.’ ( Kanz ul ‘Ummal vol. 12 pg 530)

In case of virgin wali has domination on girl but in case of widowed or divorced the opinion of woman has domination on opinion of walis.

Allah says in Holy Quran about divorced women:

When they have fulfilled their term, there is no blame on you if they dispose of themselves in a just and reasonable manner. – [Qur’an 2:234]

Similarly there is hadith in sahih Muslim about previously married woman:

“Ibn Abbas (ra) reported Allah’s Messenger as saying: A previously married woman (thaib) has more right to her person than her guardian. And a virgin should also be consulted, and her silence implies her consent.”( Sahih Muslim, in Kitab-an-Nikah)


Marriage Fiqh: A man cannot marry his mehrams or cannot take two sisters in one Nikah:


Islam has declared some relations illegal for marriage and these relations are known as mehrams for women. A muslim man/woman should have knowledge of these relations.

Allah swt says in Holy Quran:


And marry not women whom your fathers married, except what has already passed; indeed it was shameful and most hateful, and an evil way. Forbidden to you (for marriage) are: your mothers, your daughters, your sisters, your father's sisters, your mother's sisters, your brother's daughters, your sister's daughters, your foster mother who gave you suck, your foster milk suckling sisters, your wives' mothers, your step daughters under your guardianship, born of your wives to whom you have gone in - but there is no sin on you if you have not gone in them (to marry their daughters), - the wives of your sons who (spring) from your own loins, and two sisters in wedlock at the same time, except for what has already passed; verily, Allâh is Oft¬Forgiving, Most Merciful. (An-Nisa 4:22-23)


And similarly Rasool salal laho aliehi wasalam has forbidden aunt and her niece in wedlock at the same time. All muslim men and women should well aware of these relations declared illegal for marriage by Allah and His Rasool salal laho aliehi wasalam

LOVE IS A VITAL FORCE

Love is a vital force and most of the people are identified with the person they love.Love has also a religious significance and if a person loves some one than there are maximum chances that he will be in his company in hereafter.This reality has also been narrated in a hadith that prophet salal laho aliehi wasalam said that a person will be in the company of his beloved.In another hadith Prophet salal laho aliehi wasalam made it clear that a person will be in the company of his beloved even if his actions are not exactly like him.Allah requires alot of love from His creations and according to surah Taubah a person who does not love Allah His messenger and Struggle in His way more than his father , sons ,wives ,tribe ,house hold and trade than he should wait for the torment of Allah and Allah does not gude the wrong doers .So the people who love other things more than Allah and His prophet are indeed wrong doers and they are held accountable before Allah swt and they can be punished by Him at any moment.May Allah give us toufeeq to love Allah ,His messenger and all those who love them and follow their commands ameen.

to resist radical Christianity .May Allah bless us with commanders like them who can restore our glory of past .Our political leaders have changed their role models and are following the footsteps of Imperialism .We cannot dominate them unless and untill we revive our own traditions culture ,social and political system

The first gift given by American government after release of Raymond Davis was drone attacks which result in death of 40 innocent people and the 2nd response from their side is burning of Quran in Florida.

Terry jones,a biased and prejudiced pastor, who oversaw the burning of the scripture by pastor Wayne Sapp on Sunday, said that "trial" of the holy Quran was held by a jury of 12 church members and volunteers. He said

"We had a court process. We tried to set it up as fair as possible, which you can imagine, of course, is very difficult," Jones was quoted as saying by The USA Today.

The punishment -- burning the book after it had been soaked in kerosene for an hour -- was determined from four choices on his organisation's Facebook page.

Is this the freedom of expression for which American and western nations are working.It is now very much obvious that which group is promoting extremism and intolerance.




It is very strange that Muslims are being tortured physically and psychologically for a long time but even a small protest from side of Muslims is not being tolerated and whenever they raise voice for the dignity of their religion , Quran and their prophet they are accused of being fundamentalists and intolerant.Who will convey the misery and pain of Muslims to the flag bearers of humanity and human rights. No civilized person, nation or organization can support this stupid act of Terry Jones guarded and sponsored by his state.

Muslims at this moment need to establish strong relations with Quran and Holy prophet and they need to prcatise their deen more than used to do it in the past.They should overcome their internal differences to counter consistent attacks on  our religion and they should also demonstrate and protest on mass level to show their love for book of Allah and sunnah of Rasool salal laho aliehi wasalam.Demonstrations are tool of communication and there is no harm in holding big peaceful gatherings to build a pressure on those element who are working against our religion.

Backbiting is one of the worst social evils

Backbiting is one of the worst social evils which has been strictly condemned by Allah and His Rasool (p.u.bh).The person who back bites is like the one who eats the meat of his dead brother.No one will like to eat meat of the dead brother but most of us are ready to insult and redicule their brothers and sisters in their absence.This results in promotion of unrest in this life and hellfire in hereafter.

Signs of Imam Mehdi are clearly mentioned in books of hadith here are some signs mentioned in books of hadith

1st Hadhrat Abdullah bin Mas'ood(RA) reports from the Prophet(SAW), who said:



The world will not come to pass until a man from among my family, whose name will be my name, rules over the Arabs.
(Tirmidhi Sahih, Vol. 9, P. 74; Abu Dawud, Sahih, Vol. 5, P. 207;
also narrated by Ali b. Abi Talib, Abu Sa'id, Umm Salma, Abu Hurayra)
